The Hazardous Substances and New Organisms (Schedules 1AA and 2A) Order 2026 (SL 2026/264) adds chlorpyrifos, long-chain PFCAs and MCCPs to the HSNO Act schedules. MCCP and LC-PFCA restrictions apply from 16 December 2026, and chlorpyrifos from 8 July 2027 with no exemptions.

What New Zealand's Chlorpyrifos, PFCA and MCCP Controls Require

The order aligns New Zealand with recent Stockholm Convention listings. Implementation is phased, starting on 9 October 2026, with time-limited essential-use exemptions for MCCPs and LC-PFCAs running to 16 December 2031.

It also updates permitted uses of UV-328 for specified aircraft applications, including water-seal tape for insulation blankets and decking and certain adhesives and coatings.

What’s New

  • Chlorpyrifos: controlled from 8 July 2027 with no permitted uses.
  • LC-PFCAs are defined as CnF2n+1CO2H with n from 8 to 20 (C9–C21), excluding PFOA, which is listed separately. Permitted uses include semiconductors in replacement parts, and replacement parts for motor vehicles that have ceased mass production, under defined conditions.
  • MCCPs are defined as linear C14–C17 chloroalkanes. Permitted uses include flexible PVC in several construction, cable, medical-device and packaging applications (excluding food packaging), flexible elastomeric foam for thermal insulation, certain adhesives and sealants, leather fat-liquoring (except children’s products) and polymers and rubbers in repair parts.
  • Articles in New Zealand before 16 December 2026 have no expiry date where LC-PFCAs or MCCPs were used as additives in listed applications such as sealants, paints, coatings, textiles and electrical and electronic equipment.

Who and What Is in Scope

Industries: Automotive components · Spare parts · Electrical and electronic equipment · Wire and cable · Adhesives and sealants · Leather · Agrochemicals

Who is affected: Importers, manufacturers and suppliers of listed chemicals and articles in New Zealand, including automotive, electronics, construction and agricultural supply chains.

Products and standards in scope: Chlorpyrifos, long-chain PFCAs, their salts and related compounds, and MCCPs, under Schedules 1AA and 2A of the HSNO Act.

Requirements and restrictions: Restrictions on the listed chemicals with time-limited permitted uses; articles already in New Zealand before 16 December 2026 are not caught for listed additive uses.

What Companies Should Do

  • Check imported products and spare parts for LC-PFCA and MCCP content against the permitted-use lists.
  • Confirm whether existing stock qualifies for the pre-16 December 2026 article provision.
  • Plan substitution before the essential-use exemptions end in 2031.
Key Takeaway

New Zealand is moving in step with the EU on chlorpyrifos, LC-PFCAs and MCCPs. Importers should check permitted uses and stock positions before the December 2026 start date.
