The Environmental Protection Agency under the Biden Government proposed the new rule in reporting and recordkeeping of Per & Polyfluoroalkyl Substances (PFAS) under the Toxic Substances Control Act (TSCA). This was being done by the EPA based on the amendment of the National Defense Authorization Act for Fiscal Year 2020.

According to the proposed draft, a person who manufactures, distributes, imports the Polyfluoroalkyl Chemical Substances (PFAS) in any year considering January 1, 2011, need to report the information which includes i) Total Production Volumes; ii) Uses of substances; iii) the way of disposal; iv) Exposure and its measures; v) Hazardous condition of the substances. These reports should be electronically submitted to the EPA. The Manufacturers who produce PFAS as a By-product and the small-scale manufacturers are not exempted from these reporting requirements.

Now EPA accepts the public comment regarding this proposal during the 60-day commenting period. Comments should be submitted using the Federal e-Rulemaking Portal at https://www.regulations.gov/ and reference docket ID number EPAHQ-OPPT-2020-0549.
