Germany has officially adopted the Battery Law Implementation Act (Batterierecht-Durchführungsgesetz – BattDG), harmonising its national battery rules with the EU Batteries Regulation (EU) 2023/1542.

The BattDG was passed by the Bundestag and entered into force on 7 October 2025 (Federal Gazette BGBl. I Nr. 233/2025), establishing a comprehensive regulatory framework for all batteries sold in Germany.

Scope and Compliance Timeline

The BattDG applies to all battery types, including:

• Portable batteries
• Industrial batteries
• Light-means-of-transport (LMT) batteries
• Automotive and electric vehicle (EV) batteries

Key Dates:

• EU Regulation fully effective: 18 August 2025
• Mandatory supply chain due-diligence obligations: since August 2025

The law ensures full alignment between German and EU requirements.

Regulatory Requirements

Producer & Distributor Obligations:

• Mandatory producer registration before market placement
• Distributors may be considered producers if placing unregistered batteries on the market
• Required participation in Producer Responsibility Organizations (PROs)

Collection & Recycling Rules:

• Strengthened battery take-back systems
• Higher collection targets, including ≥50% collection rate for portable batteries
• Deposit system for certain starter batteries (e.g., €7.50 refund)

Labelling & Documentation:

• Updated battery labelling and identification standards
• Enhanced supply-chain traceability and documentation
• Brand-specific registration obligations

Environmental & Supply-Chain Controls:

• Resource efficiency and recyclability requirements
• Future due-diligence standards for battery raw materials and global supply chains

Companies in Germany involved in battery manufacturing, import, or distribution must:

• Verify producer registration status
• Update labelling and documentation systems
• Strengthen battery take-back and recycling plans
• Prepare for audit and compliance inspections
• Implement supply-chain traceability systems
