Vietnam has officially implemented three supporting government regulations to operationalize the Law on Chemicals (No. 69/2025/QH15), strengthening national control over hazardous chemicals, chemical safety, and industry oversight.

The decrees were issued by the Ministry of Industry and Trade (MOIT) and came into force on January 17, 2026, following the Law on Chemicals’ effective date of January 1, 2026.

Overview of the Three Supporting Decrees

The newly enforced decrees provide detailed guidance on chemical classification, safety management, and hazardous chemical control across production, trade, and import activities:

  • Decree No. 24/2026/NĐ-CP – Chemical classification lists and regulatory scope
  • Decree No. 25/2026/NĐ-CP – Chemical industry development and safety management
  • Decree No. 26/2026/NĐ-CP – Management of hazardous chemicals and chemical-containing products

Together, these regulations establish a comprehensive framework for implementing the Law on Chemicals.

Decree No. 24/2026/NĐ-CP: Chemical Lists and Control Scope

This decree formally publishes the chemical lists regulated under the Law on Chemicals, defining substances subject to conditional management and enhanced safety requirements.

Key appendices include:

  • Appendix I: 39 basic chemicals critical to industrial development
  • Appendix II: 786 chemicals and mixtures subject to conditional production and trade (including mixtures containing ≥5% of listed substances)
  • Appendix III: 241 chemical precursors and precursor mixtures under special control
  • Appendix IV: 271 individual chemicals and 21 chemical groups requiring accident prevention and emergency response planning

These lists serve as the regulatory foundation for chemical supervision in Vietnam.

Decree No. 25/2026/NĐ-CP: Chemical Industry and Safety Management

Decree No. 25/2026/NĐ-CP details the implementation of chemical industry development and safety obligations, including:

  • Responsibilities of competent authorities
  • Chemical industry planning and development criteria
  • Technical and safety requirements for chemical projects
  • Mandatory safety training and emergency preparedness
  • Accident prevention and response mechanisms

The decree establishes standardized safety governance throughout the chemical lifecycle.

Decree No. 26/2026/NĐ-CP: Hazardous Chemical and Import Controls

This decree introduces enhanced controls on hazardous chemicals and chemical-containing products, with a focus on transparency and traceability.

Import Declaration Requirements

Importers of chemicals classified under Chapters 28 and 29 of Vietnam’s Import-Export Tariff must submit chemical declarations via the National Single Window system prior to customs clearance. Limited exemptions apply for small-scale testing imports and mixtures with hazardous components below 0.1%.

Hazardous Chemical Disclosure

Authorities will publish lists of products and categories containing hazardous chemicals that require disclosure, in line with Article 31 of the Law on Chemicals.

Production and Supply Chain Monitoring

Enterprises must implement controls covering:

  • Raw materials and intermediate substances
  • Emissions and losses during production
  • Hazardous chemical content in final products

Product Information Transparency

Manufacturers and importers of products containing hazardous chemicals are required to disclose:

  • Product name
  • Hazardous chemical identity and properties
  • Chemical content and intended use

This information must be entered into the national chemical database and made available through labels or electronic information platforms, including usage restriction guidance.

The entry into force of these three decrees represents a major regulatory shift for chemical manufacturers, importers, and downstream users in Vietnam. Affected companies should:
