The proposal to amend Title 27, California Code of Regulations by adding a new subsection 25607.2(b) to Section 25607.2 was approved by the Office of Administrative Law on October 26, 2022. This new part addresses the need for additional non-mandatory safe harbor warning options for companies that significantly increase acrylamide exposures in food by addressing warning content for those exposures.

The regulation will be effective begining January 1, 2023.

• (a) A warning for food exposures, including those from dietary supplements, satisfies this sub article’s standards if it is presented using one or more of the techniques listed in Section 25607.1 and contains all of the features listed below:
• (1) The term "WARNING:" in bold text and all capital characters.
• (2) For exposure to a designated carcinogen, the warning " Consuming this product may expose you to chemicals such as [name of one or more chemicals], which have been linked to cancer in the state of California." Visit www.P65Warnings.ca.gov/food for further details.
• (3) The terms "for exposure to a recognized reproductive toxin," You may be exposed to chemicals from this product, including one or more that the State of California is aware can result in birth defects or other reproductive damage." Visit www.P65Warnings.ca.gov/food for further details.
• (4) Consuming this product can expose you to chemicals, including name of one or more chemicals known to the State of California to cause cancer and name of one or more chemicals known to the State of California to cause birth defects or other reproductive harm, for exposure to both listed carcinogens and reproductive toxicants. • (5) The warning for exposure to a substance that is both a carcinogen and a reproductive toxin You may be exposed to chemicals from this product, including [name of one or more chemicals], which the State of California is aware [is] known to cause cancer, birth defects, and other reproductive damage.
• (6) The phrase "chemicals including" may be removed from the warning language specified in subsections when a warning is being provided for an exposure to a single chemical. in subsections (2), (3) and (5).
• (b) If a warning is given in accordance with paragraph (a) or (ii) using one or more of the techniques listed in Section 25607.1 and includes both items (1) and (2) below, it satisfies the requirements of this subsection. (1) The words "CALIFORNIA WARNING:" in bold font and capital characters. (2) The statement that using this product exposes you to acrylamide, a chemical that is likely carcinogenic to humans and is produced when some foods are cooked or processed at high temperatures.
