Canada has issued a mandatory information request involving 850 chemical substances. Published on June 24, 2023, in the Canada Gazette, this request aims to gather essential data for prioritization, risk assessment, and risk management purposes. It aligns with Section 71 of the Canadian Environmental Protection Act (CEPA)and entails information collection from Canadian manufacturers, importers, and users. The objective is to assess the toxicity and control measures related to these substances.

Scope of the Request 

The information request covers a wide range of substances, spanning four distinct categories:

Obligated Parties

The information request applies to individuals or entities that, during the reporting year, have:

  • 1. Manufactured a total quantity greater than 100 kg of a substance listed in Part 1 or Part 4 of Schedule 1 or manufactured a total amount greater than 1,000 kg of a substance listed in Part 2 of Schedule 1.
  • 2. Imported a total amount greater than 100 kg of a substance listed in Part 1 or Part 4 of Schedule 1 or imported a total amount greater than 1,000 kg of a substance listed in Part 2 of Schedule 1 under specific conditions.
  • 3. Used a total amount greater than 100 kg of a substance listed in Part 1 or Part 4 of Schedule 1 or used an unlimited amount greater than 1,000 kg of a substance listed in Part 2 of Schedule 1 in the manufacture of mixtures, products, or manufactured items, under specific conditions.
  • 4. Used a total quantity greater than 100 kg of a substance listed in Part 3 of Schedule 1 to manufacture mixtures, products, or items under specific conditions.
  • 5. Used a total quantity greater than 100 kg of a substance listed in Part 4 of Schedule 1 in activities other than manufacturing mixtures, products, or manufactured items under specific conditions.

Exemptions 

Certain exemptions apply to the substances, such as those in transit through Canada, regulated hazardous waste or recyclable materials, and specific categories like pest control products, fertilizers, and more. A comprehensive list of exemptions is detailed in the notice.

Information Required 

Entities subject to this information request must provide crucial details, including:

  1. Name of the person or entity.
  2. Address
  3. Federal business number.
  4. An authorized representative’s Contact information (name, address, email, and phone number).
  5. A declaration of the accuracy and completeness of the information provided.

The deadline for responses is January 17, 2024, and if applicable, a single answer can be submitted for multiple facilities owned by the same entity.
